Willis applied for the discharge of William Nicholas Mercer Scutts, solicitor, who was adjudged bankrupt on Oct 12 1898, with liabilites £135 and assets which have realized £3.10s 11d. It appeared that some 35 years age the bankrupt made an arrangement with his creditors, under which he paid 2s.6d. in the pound on claims amounting to £40, and that he had recently omitted to keep proper books of account. Mr.C.A.Pope attended as Assistant Official Receiver. Mr. Registrar Linklater granted the discharge subject to judgement being entered up against the bankrupt for £100.] [The London Gazette (1901) Scutts, William Nicholas Mercer - 16 Water Lane, Great Tower Street, in the city of London, lately carrying on business at 14 Harp Lane, Great Tower Street aforesaid Solicitor - High Court of Justice in Bankruptcy 708 of 1898 Dec 11 1900 - Bankrupt discharged subject to the following condition, to be fulfilled before his Discharge takes effect, viz. : Bankrupt shall, before the signing of this Order, consent to Judgment being entered against him in the Queen's Bench Division of the High Court by the Official Receiver for the sum of £100, being part of the balance of the debts provable in the Bankruptcy which is not satisfied at the date of this Order, and £1 10s., costs of Judgment, and that, upon the required consent being given, Judgment may be entered against the bankrupt in the Queen's Bench Division of the High Court for the sum of £100, together with £1 10s., coats of Judgment; his Public Examination having been concluded on the 15th November 1898 - Bankrupt's assets are not of a value equal to 10s in the pound on the amount of his unsecured liabilities; that he had omitted to keep such books of account as are usual and proper in the business carried on by him, and as sufficiently disclose his business transactions and financial position within the three years immediately preceding his bankruptcy; and had on a previous occasion made an arrangement with his creditors.] [N M S 75yr.]
