Important to Farmers: Employer's and Workmen's Act. Enoch Cousins and Win. labourers, were summoned by Wm. Scutt, farmer, Swinefleet, under the Employers and Workmen's Act for breach of contract in leaving their work four days after they had entered his service. W. Everatt appeared for the complainant, and Mr Everatt Hind for defendants. A legal discussion took place whether actual contract been entered into. Mr Hind argued at some length from the law as laid down in the Statute of Frauds, and ultimately the Bench read another case which bore out Mr Hind's contention, and dismissed the summons with the remark that it was a matter of great concern for the farmers. The law was clear, and the Beach suggested that the farmers should get the men to sign a note which would then constitute an agreement for hiring. This not having been done, they dismissed the case, and refused defendants their costs.] [Sheffield Daily Telegraph Fri 17 Oct 1902. Doncaster County Court. A frightful accident occurred at Maxwell on Monday by which Miss Annie, daughter of Mr William Scutt, of that place, met her death in a peculiarly sad and tragic manner. Miss Scutt had driven her brother to Dundalk station to meet the morning train and on her return journey the accident happened. While descending Fenwick's Hill on the 4th line something gave way allowing the tongue to drop. Miss Scutt wound the lines around her hands in order to hold the horses, but the democrat became overturned and the unfortunate young woman was dragged by the frightened team for half a mile before they were stopped. The young woman was dead when picked up. Her neck and other bones were broken. The sad event has cast a gloom over the neighborhood. The parents of deceased have much sympathy extended them in the terrible loss which they have been called upon to bear. |
